1. Introduction

Welcome to Tuko Active. By accessing our website or booking any of our services, you agree to these Terms and Conditions.

2. Services

Tuko Active provides:

  • Guided hiking experiences

  • Outdoor fitness activities

  • Event bookings and coordination

All activities are subject to availability and may change due to weather, safety, or operational reasons.

3. Bookings & Payments

  • Bookings are confirmed upon payment of either a deposit or full amount

  • Full payment must be completed before the event date unless otherwise stated

  • Payments are made via M-Pesa or other approved methods

Tuko Active reserves the right to cancel bookings that are not fully paid within the required timeframe.

4. Cancellation & Refund Policy

By Participant

  • Deposits may be non-refundable unless stated otherwise

  • Cancellations made close to the event date may not be eligible for a refund

By Tuko Active

  • In case of cancellation (e.g. weather, safety concerns), participants may:

    • Receive a refund, or

    • Transfer to a future event

5. Assumption of Risk

By participating in any Tuko Active event, you acknowledge that:

  • Outdoor activities involve inherent risks (e.g. injury, weather conditions, terrain challenges)

  • You participate voluntarily and at your own risk

6. Health & Fitness

You confirm that:

  • You are physically able to մասնակցate in the selected activity

  • You will inform us of any medical conditions that may affect your participation

Tuko Active reserves the right to deny participation if safety is a concern.

7. Participant Responsibilities

You agree to:

  • Follow instructions from guides and organizers

  • Respect fellow participants and the environment

  • Arrive on time and prepared (gear, clothing, etc.)

8. Limitation of Liability

Tuko Active is not liable for:

  • Personal injury, loss, or damage during events

  • Loss of personal belongings

  • Delays or disruptions beyond our control

9. Media & Content

By participating, you agree that:

  • Photos/videos taken during events may be used for marketing and promotional purposes

If you prefer not to appear, you may notify us in advance.

10. Changes to Events

We reserve the right to:

  • Modify routes, schedules, or event details

  • Cancel or reschedule events when necessary

11. Intellectual Property

All website content (text, images, branding) belongs to Tuko Active and may not be used without permission.

12. Governing Law

These Terms are governed by the laws of Kenya.
